Medical Malpractice Law in Washington State

What is Medical Malpractice?

Medical malpractice is when a healthcare provider is negligent.  In order to prove negligence, you must be able to show through expert testimony that the healthcare provider’s actions fell below the accepted standard of care.  In Washington, the statute that governs medical malpractice is RCW 7.70.  More specifically, RCW 7.70.040 governs the elements necessary to prove a medical malpractice claim.
